How to Apply for a Marriage License in Delaware

Delaware is different. marriage under 18 fully banned, no exceptions

In Delaware, marriage license applications are processed through the Clerk of the Peace in each county. Applicants must apply in person; no online or remote application process is available. Applicants should bring a government-issued photo ID and proof of age. Delaware's statewide fee structure applies, with different fees for residents and non-residents. A waiting period does not apply; the license becomes effective the day after issuance for residents and is typically effective immediately for non-residents.

Delaware law prohibits marriage for anyone under 18 years of age with no exceptions. Individuals seeking a marriage license should contact their county Clerk of the Peace directly to confirm the current application process, required documentation, and applicable fees, as procedures and costs may vary by county or change over time.

  1. Apply at Clerk of the Peace (county office, statewide fee schedule).
  2. Bring government photo ID; proof of age.
  3. Pay the license fee ($50 (DE residents) / $100 (non-residents)).

Confirm with the issuing office. Hours, appointment rules and accepted documents differ by county. Informational only — not legal advice.

Plan the paperwork around the ceremony

Time the license application to your wedding date: most states have a validity window and some have a short waiting period between issuing the license and the ceremony. Apply early enough that the license is valid on the day — and confirm the exact windows with the issuing county clerk before you lock in plans.
